Returns & Refunds Policy
We want every transaction to be fair to both buyers and sellers. Because items sold on our marketplace are generally pre-owned, secondhand, vintage, clearance, or otherwise resold goods, items may show reasonable signs of use unless the listing states otherwise.
Our return policy protects buyers when an item materially differs from its listing while also protecting sellers from returns based solely on preference or buyer’s remorse.
1. When a Buyer May Request a Return
A buyer may request a return if the item they receive is materially different from the item described in the listing, including:
- The wrong item was shipped.
- The item is materially different in color, model, size, quantity, or type from the listing.
- The item has undisclosed damage or a significant defect that was not shown or described.
- The item is missing a major component or accessory that was specifically included in the listing.
- The item arrives damaged, and the damage appears to have occurred during shipping.
- The item appears counterfeit when it was represented as authentic.
- The listing materially misrepresented the item’s condition, functionality, or characteristics.
A return request should include photographs or other evidence that clearly demonstrates the issue.
2. Issues That Generally Do Not Qualify
A return will generally not be approved when:
- The buyer simply changes their mind.
- The buyer no longer wants the item.
- The item does not fit, when the listing provided accurate measurements or sizing information.
- The buyer ordered the wrong item, size, color, or variation.
- The item has ordinary wear consistent with its description and photographs.
- The buyer was aware of a defect, damage, or missing component before purchasing.
- The difference is minor and does not materially affect the item’s value, appearance, or functionality.
For used and secondhand items, reasonable wear, aging, cosmetic imperfections, and variations should be expected when they are accurately disclosed or reasonably apparent from the listing.
3. Return Request Period
Buyers must report an eligible problem within 3 days after confirmed delivery.
The buyer should provide:
- A description of the problem.
- Clear photographs showing the issue.
- Photographs of the packaging when claiming shipping damage.
- Any other information reasonably requested to evaluate the claim.
Requests submitted after the return period may be denied unless there are exceptional circumstances.
4. Seller Responsibilities
Sellers are responsible for creating accurate listings and should:
- Describe the item’s condition honestly.
- Disclose significant defects, damage, repairs, or missing components.
- Provide accurate photographs.
- Avoid misleading titles, descriptions, or photographs.
- Ship the item described in the listing.
- Package the item appropriately for shipment.
Sellers should not be expected to guarantee that a used item will have the same condition or appearance as a brand-new product unless they specifically represented it as new.
5. Buyer Responsibilities
Buyers are responsible for reviewing the listing, photographs, measurements, condition description, and other available information before purchasing.
After delivery, buyers should inspect their order promptly and report any eligible issue within the applicable return period.
Buyers must not intentionally damage, alter, misuse, or materially change an item in order to obtain a refund.
6. If a Return Is Approved
If a return is approved, the buyer will receive instructions for returning the item.
Unless otherwise authorized, the buyer must return the same item received and should package it securely.
The returned item should be in substantially the same condition as when it was delivered, except for reasonable inspection needed to determine whether the item has the reported issue.
Once the return is received and reviewed, the eligible refund will be processed.
7. Return Shipping
When the seller is responsible because the item was materially misrepresented, the wrong item was sent, or another seller-related issue occurred, the seller may be responsible for the return shipping cost.
When the buyer is responsible for the return, the buyer may be responsible for return shipping.
For shipping damage, the platform may determine responsibility based on the available evidence and applicable shipping protections.
8. Partial Refunds
In some circumstances, a partial refund may be offered instead of requiring a return.
For example, a partial refund may be appropriate when:
- The item has a minor undisclosed defect.
- A non-essential accessory is missing.
- The item has a cosmetic issue that does not substantially prevent its use.
- Both parties agree that keeping the item with an appropriate partial refund is a reasonable resolution.
A buyer is not required to accept a partial refund in place of an approved return unless otherwise agreed to by the buyer.
9. Wrong or Missing Items
If a buyer receives the wrong item, the buyer should report the issue within the return period.
If an item or significant component is missing from the shipment, the buyer should provide photographs of the package and its contents when possible.
Depending on the circumstances, we may arrange a return, replacement, partial refund, or full refund.
10. Items Damaged During Shipping
Buyers should photograph the package and item as soon as possible when an order arrives damaged.
The packaging should be retained until the claim has been resolved, as photographs or inspection of the packaging may be necessary to determine whether the damage occurred during transit.
Shipping claims may be subject to the requirements and limitations of the applicable shipping carrier or insurance provider.
11. Authenticity and Prohibited Items
Items represented as authentic must be authentic to the best of the seller’s knowledge and must comply with all applicable marketplace rules.
Counterfeit, stolen, prohibited, or otherwise unlawful items are not permitted.
If an item is determined to violate these requirements, the transaction may be cancelled and/or refunded, and additional action may be taken against the account.
12. Returns Outside the Platform
Buyers and sellers should use the platform’s designated return and refund process.
We generally cannot provide transaction protection for returns, refunds, or payments arranged privately outside the platform.
13. Fraud and Abuse
We may deny a claim or take action against an account when there is evidence of:
- False or misleading claims.
- Repeated abusive return requests.
- Returning a different item from the one purchased.
- Removing or replacing components before returning an item.
- Intentional damage or misuse.
- Manipulation of photographs or other evidence.
- Other attempts to improperly obtain a refund.
Repeated abuse may result in account restrictions, suspension, or removal.
14. How Disputes Are Reviewed
When necessary, we may review information from both the buyer and seller, including:
- The original listing.
- Listing photographs.
- Messages between the parties.
- Order and shipping information.
- Photographs or videos provided by either party.
- The item’s condition before and after shipment.
- Tracking and delivery information.
- Other relevant evidence.
Both parties are expected to provide truthful and complete information.
We will make decisions based on the available evidence and the circumstances of the transaction.
15. Refund Processing
Approved refunds will generally be returned to the buyer’s original payment method.
The time required for a refund to appear in the buyer’s account may depend on the payment provider or financial institution.
16. Final Resolution
We reserve the right to determine the appropriate resolution for a transaction based on the available evidence and the circumstances of the case.
Possible resolutions may include:
- No refund.
- Partial refund.
- Return and refund.
- Full refund without requiring a return in appropriate circumstances.
- Cancellation of the transaction.
- Other reasonable remedies.
We may update this policy from time to time. The applicable version will generally be the version in effect when the transaction was completed.
Prohibited Items and Seller Violations Policy
Halloween Super Store is committed to providing a safe, lawful, and trustworthy marketplace for buyers and sellers. Sellers are responsible for ensuring that every item they list complies with this policy and with all applicable federal, state, and local laws.
1. Prohibited Items
Sellers may not list, sell, or attempt to sell items that are prohibited by law, this policy, our Terms of Service, or applicable payment and shipping requirements.
Prohibited items include, but are not limited to:
Illegal Items
Items that are illegal to possess, sell, purchase, or distribute under applicable law are prohibited.
Weapons and Explosives
Firearms, ammunition, explosives, explosive devices, and other prohibited weapons or weapon components are not permitted.
Halloween Super Store may also prohibit additional weapons or weapon-related products regardless of whether they are legal in a particular jurisdiction.
Drugs and Controlled Substances
Illegal drugs, controlled substances, prescription medications offered without appropriate authorization, drug paraphernalia, and products intended to facilitate illegal drug activity are prohibited.
Alcohol, Tobacco, and Nicotine Products
Alcohol, tobacco products, nicotine products, and regulated vaping products are prohibited unless Halloween Super Store expressly permits a particular category and the seller satisfies all applicable legal and platform requirements.
Counterfeit and Unauthorized Goods
Counterfeit, replica, fake, or unauthorized goods are prohibited.
Sellers may not list products that infringe another person’s or company’s copyright, trademark, patent, or other intellectual property rights.
Stolen Property
Items that the seller knows or reasonably should know are stolen or unlawfully obtained may not be listed or sold.
Recalled or Unsafe Products
Products that have been recalled by a manufacturer or government agency, or products that present an unreasonable health or safety risk, may not be listed.
Sellers are responsible for ensuring that their products comply with applicable product-safety requirements.
Hazardous Materials
Products that cannot legally or safely be shipped through the selected shipping service are prohibited.
This may include certain explosives, highly flammable materials, toxic substances, and other hazardous materials.
Adult and Explicit Content
Pornographic material and other prohibited sexually explicit products or content are not permitted.
Hate and Violent Content
Items or listings that promote, glorify, or encourage hatred, violence, terrorism, or discrimination against individuals or protected groups are prohibited.
Human Remains and Bodily Materials
Human organs, human remains, bodily fluids, and other prohibited human biological materials may not be listed or sold.
Endangered or Protected Wildlife
Products made from protected or endangered animals, or products whose sale is restricted under applicable wildlife laws, are prohibited.
Personal and Financial Information
Listings may not contain or offer stolen account credentials, passwords, payment information, Social Security numbers, or other sensitive personal information.
Fraudulent or Deceptive Products
Items that are intentionally misrepresented, deceptively described, or designed to facilitate fraud are prohibited.
Items Designed to Circumvent Security or Law
Products or services specifically designed to bypass security systems, access controls, copyright protections, or other legal restrictions may be prohibited.
2. Halloween and Costume-Specific Restrictions
Because Halloween Super Store specializes in Halloween-related products, certain items may require additional restrictions.
Costume weapons, replicas, props, masks, makeup, special effects products, and similar merchandise must comply with applicable laws and safety requirements.
A product being marketed as a “costume,” “prop,” “toy,” or “novelty” item does not automatically make it permissible.
Halloween Super Store may restrict or prohibit an item when its design, intended use, or applicable law creates a safety or legal concern.
3. Seller Responsibility
Sellers are responsible for knowing what they are listing and ensuring that their listings comply with:
- Halloween Super Store policies
- Applicable federal, state, and local laws
- Shipping carrier requirements
- Payment-provider requirements
- Intellectual property laws
- Product-safety requirements
Sellers should not assume that an item is permitted simply because it is available for sale elsewhere.
4. Listing Accuracy
Sellers may not attempt to disguise or misrepresent a prohibited item in order to bypass our policies.
Examples include:
- Using misleading titles or descriptions
- Mislabeling an item
- Placing a prohibited item in an unrelated category
- Using coded language to conceal the nature of an item
- Removing identifying information from photographs
- Listing prohibited items as “props” when they are actually intended for another use
- Creating replacement listings after a prohibited listing has been removed
5. Enforcement
If Halloween Super Store determines that a listing violates this policy, we may take one or more of the following actions:
- Remove or hide the listing
- Cancel the transaction
- Prevent the item from being relisted
- Issue a warning
- Restrict the seller’s listing privileges
- Restrict or suspend the seller’s account
- Permanently terminate the seller’s account
- Withhold or delay funds when reasonably necessary to address refunds, chargebacks, fraud, legal obligations, or other transaction risks
- Cooperate with law enforcement or government authorities when legally required or appropriate
The action taken may depend on the nature and severity of the violation, the seller’s history, and applicable legal requirements.
6. Repeated or Serious Violations
Repeated violations may result in progressively stronger account restrictions.
Halloween Super Store may immediately suspend or terminate an account for serious violations, including suspected illegal activity, fraud, threats to user safety, counterfeit goods, or attempts to circumvent enforcement.
Creating another account to avoid a suspension or termination is prohibited.
7. No Intent Required
A seller may be responsible for a prohibited listing even if the seller claims that the violation was accidental or unintentional.
Sellers are expected to review this policy and determine whether their items are permitted before listing them.
8. Reporting Prohibited Items
Buyers and sellers may report listings that they believe violate this policy.
Halloween Super Store may review reported listings and take appropriate action.
Submitting a report does not guarantee that a listing will be removed.
9. Removal Does Not Determine Legal Ownership
Removing a listing does not necessarily determine whether an item is legally owned, legally possessed, or legally transferable.
Halloween Super Store may remove an item whenever we reasonably believe that doing so is necessary to protect users, comply with applicable law, comply with our partners’ requirements, or maintain the integrity of the marketplace.
10. Policy Updates
Halloween Super Store may update this policy from time to time as laws, regulations, marketplace requirements, and safety standards change.
Sellers are responsible for reviewing the current version of this policy before listing items.
11. Questions
If you are unsure whether an item is permitted, do not list the item until you have reviewed the applicable policy or contacted Halloween Super Store Support.
Halloween Super Store reserves the right to determine whether a particular item or listing is permitted on the marketplace.
Selling Fees
Vertual Attics Selling Fees Policy
Update: [9\24\26]
At Vertual Attics, we keep selling simple and transparent. There is no fee to create or maintain a listing. You pay a selling fee only when your item sells.
1. Listing Fees
Listing an item on Vertual Attics is free.
There are no upfront fees to create, edit, or maintain an active listing.
2. Selling Fee
Vertual Attics charges a 7.5% selling fee on the total transaction amount.
The selling fee is calculated based on:
- The final item sale price
- Any shipping amount paid by the buyer
The selling fee is automatically deducted from the seller’s proceeds.
Example
If an item sells for $50.00 and the buyer pays $8.00 for shipping:
- Item price: $50.00
- Buyer-paid shipping: $8.00
- Total transaction amount: $58.00
- Vertual Attics selling fee (7.5%): $4.35
- Seller proceeds: $53.65
3. Payment Processing
Vertual Attics does not charge a separate payment-processing fee for standard transactions unless otherwise stated.
If additional fees apply to a particular payment method or financial service, those fees will be disclosed to the seller before the service is used.
4. Shipping Costs
Shipping costs may vary depending on the shipping carrier, package size, package weight, destination, and shipping method selected.
If the buyer pays for shipping, the buyer-paid shipping amount is included when calculating the 7.5% selling fee.
If the seller offers free shipping, the seller is responsible for the applicable shipping cost unless otherwise stated.
5. Canceled Orders
Selling fees are generally not charged when an order is canceled before the transaction is completed.
Vertual Attics may charge a cancellation fee or take other action when a seller repeatedly cancels orders, fails to ship sold items, or otherwise violates marketplace policies.
6. Shipping Adjustments
Sellers are responsible for providing accurate information about the package when purchasing or generating a shipping label.
If the shipping carrier determines that a package exceeds the weight, dimensions, or other requirements associated with the selected shipping label, any resulting additional shipping charges may be deducted from the seller’s proceeds.
7. Refunds and Returns
If an order is refunded, the selling fee may be reversed or adjusted depending on the circumstances of the refund.
Certain costs that have already been incurred, including applicable shipping or third-party service fees, may not be refundable.
8. Optional Services
Vertual Attics may offer optional services that have additional fees, including:
- Promoted or boosted listings
- Featured listings
- Authentication services
- Expedited payment services
- Additional shipping services
- Other premium seller tools
Any applicable fee will be clearly displayed before the seller purchases or activates an optional service.
9. Taxes
Applicable sales taxes, marketplace taxes, and other government-required charges may be calculated and collected as required by applicable law.
Sellers are responsible for understanding and complying with their own tax obligations. Vertual Attics does not provide individual tax advice.
10. Seller Earnings
Seller earnings will reflect the applicable selling fee and any other deductions associated with the transaction.
For example, if an item sells for $100.00 and the buyer pays $10.00 for shipping:
- Total transaction amount: $110.00
- 7.5% selling fee: $8.25
- Seller proceeds: $101.75
Actual proceeds may vary if the order is refunded, canceled, adjusted, or subject to additional applicable charges.
11. Changes to Selling Fees
Vertual Attics may modify its fees from time to time.
If we make a material change to the selling fee, we will provide notice before the updated fee takes effect.
Unless otherwise stated, the updated fee will apply only to transactions occurring after the new fee becomes effective.
12. Fee Disputes
If you believe a fee was calculated or charged incorrectly, please contact Vertual Attics Customer Support within 30 days of the applicable transaction.
Please include the order number and any relevant transaction information so we can investigate the issue.
13. Agreement to Fees
By listing and selling an item on Vertual Attics, you acknowledge and agree to the applicable fees described in this Selling Fees Policy.
Vertual Attics reserves the right to enforce these fees and any additional charges disclosed to sellers in connection with specific services or transactions.
